I currently represent myself (pro se) to preserve my rights but I am not an attorney. I suffered a closed-head injury to the hypothalamus that went undiscovered and the symptoms ignored by Drs when presented. Drs. never evaluated and head, spine , c-spine after traumatic high speed crash. They only treated obvious injuries, i.e. ruptured achilles heel, ruptured hamstrings complete destruction of quadriceps, complete destruction of gluteas maximus muscle, complete separation of sciatic nerves from spine and significant, obvious from CT Scan, frontal impact damage to brain. previous to this accident I weighed 172 lbs and now weigh 96 lbs and continue to have difficulty keeping food/water down, extreme homeostatic temperature changes varies from 89.4 to 104.7, I need help that is beyond my reach. Accident happened 5/5/05 and I need all the help I can get. I do not qualify for Tn Asst. because I am white, single ,have no dependants a category for my position does not exist. Help PLZ

There are cases when the negligence of others hurts people. In cases like this people may feel overwhelmed and excited and they may find it difficult to decide what steps to take to overcome that situation. The best choice in such cases is hiring a malpractice attorney who will handle the case. In general there are certain standards which the medical professionals should adhere to. But not all doctors follow these standards. As a result we face malpractice. Cases of malpractice differ greatly. For instance, the unsanitary use of instruments and not proper use of instruments can be considered to be a case of malpractice. Or if the doctor gives a wrong diagnosis and, hence, wrong treatment, we again deal with malpractice. The fact remains true that in the majority of cases the doctors do not take the responsibility for their mistake. In such cases it is necessary to hire a malpractice attorney who will defend your rights and get compensation for the loss and pain you have suffered.5 questions to ask when you are interviewing a malpractice attorney are as follows:1. Who will handle my case? Generally the person who you are talking to is the person who will handle the case and supervise over the whole process. But there are also cases when you talk to some attorney in a law firm, and then find out that another attorney is going to deal with your case.2. What is your experience in dealing with such cases? This question will help to identify how skilled the attorney you are interviewing is.3. Are you a member of any organization related to medical malpractice?4. What are the fees for your services?5. Can I have some references from your past clients? These 5 questions will help you choose the right malpractice attorney.

Article by Erich Shrefler

Falling victim to medical malpractice is a painful and traumatic experience. Patients rightly put a large amount of trust in doctors, and when that trust is violated, the results can be permanently damaging. Proving medical negligence, or medical malpractice can be difficult, and it takes an experienced lawyer to be able to tell the difference between a worthy case and a frivolous lawsuit. Frivolous lawsuits actually hurt the chances of credible medical malpractice suits from having success and good attorneys should avoid them. If you have been the victim of medical malpractice, finding a lawyer to represent your best interests is of the highest importance.

What Should You Look For?The key characteristics you should look for in a medical malpractice attorney are:* Medical expertise* Experience* Verdict settlements* Individual care and attention

Medical ExpertiseTo establish medical malpractice, you must prove that injury resulted when a doctor made an error or otherwise deviated from standard health practices. To prove this, expert medical testimony must be given. Lawyers with both a J.D. and M.D. have a unique dual perspective that allows them to identify necessary and convincing testimony to prove error to a jury.

ExperienceMedical malpractice suits are complicated cases that can be particularly difficult to pursue. Lawyers with extensive experience are more likely to be able to find the right angles to get a favorable outcome for your case. Particularly given the range of injuries that can be sustained in botched medical procedures, hiring a lawyer who has dealt with these types of cases and the medical community is key. Medical malpractice can occur at a doctor’s office, the hospital, an ER bed, and even a nursing home. Shouldn’t you demand a lawyer with experience in all of these types of medical malpractice or negligence cases?

Verdict SettlementsAlthough it is no guarantee, one way of gauging whether a law firm has a chance of success in your case is by looking at their past cases. If a law firm isn’t open about its prior winning medical malpractice verdicts and settlements, you should probably avoid them and look for a more proven firm.

Individual CareYour case is important to you, and it should be important to your lawyer as well. More than that, though, you should look for a lawyer who has empathy for you as a person and has your best interests at heart, above and beyond their commission or fee.

Question by Welcome Eden Quade! 4/21/2009: What type of attorney do we need?
Ok, so we have twins in the NICU (17 weeks early). They called us in one day to have a meeting and told us that my husband is not allowed to see our girls without an armed escort and for one hour a day ONLY between the hours of 3pm and 4pm and he’s not allowed to go anywhere else in the hospital (not even the cafeteria for food) and he has to go through a metal detector when he goes in. All of this is because a few nurses think he “looks intimidating and he doesn’t say much” which makes them “unable to work” when he is around.I just want to know if his parental rights come into play here. Is he being discriminated against?? Should he be allowed to see his kids?? He can’t help the way he looks. It isn’t like he doesn’t smile or isn’t nice… He’s never done ANHTHING out of line in anyway. The only thing he does is ask for updates on the girls and make sure they are ok. Then he just sits with the girls and watches them. (It’s all we can do they are still too small to touch/hold)

Please let us know your opinion and what kind of attorney we need for this specific situation. We can’t seem to find one who deals with discrimination in the medical field. The only lawyers we can find is medical negligence and medical malpractice.
ok first off esther no there isn’t more to the story.. it’s exactly what happened. i didn’t ask for ur bullshit answer to increase your stupid point rank screw off. and as for the other answer i recieved thank u i’ll be contacting someone with civil rights because this hospital is the only hospital my kids CAN be at because they are too sick to be anywhere else or be transfered and i dont feel like puttin up with their crap sayin he can’t see his own damn kids when he’s not done anything. appreciate your help.

Best answer:

Answer by Esther
You need an Armed Escortarian.

See a criminal law lawyer. There is more to this story than you are telling us.

Chicago, IL (PRWEB) October 03, 2011

A new online database listing the disciplinary, criminal and malpractice histories of all Illinois doctors and chiropractors will go live later this fall ? and it will give patients an added layer of protection against negligent practitioners, Chicago medical malpractice attorney Patrick A. Salvi said today.

?This will be valuable new tool for the public to use in their search for qualified physicians,? said Salvi, whose Chicago medical malpractice law firm, Salvi, Schostok & Pritchard P.C., represents clients in negligence claims throughout Illinois, including Cook County and Lake County.

?Too often we see cases that involve doctors who have convictions or malpractice payments in their pasts and injured clients who had no idea about those histories,? Salvi said.

Creation of the database was authorized by the Illinois legislature in August, when it passed the Patients? Right to Know Act. Similar legislation had been proposed and blocked in prior years.

However, a series of articles in the Chicago Tribune earlier this year reported that state regulators had allowed ?dangerous doctors? to continue practicing ? even those convicted of sex crimes.

?Obviously existing safeguards weren?t working well enough,? Salvi said. ?But the Patients? Right to Know Act will empower patients to do everything they can to choose the doctor that they are most comfortable with ? and will expose doctors who have past cases of medical negligence in their records.?

The Patients? Right to Know Act allows the publication of basic information about Illinois physicians and chiropractors, including their full names, their professional and academic credentials, where they have worked, and whether they work in a setting that accepts Medicaid.

But the profiles also will list any medical malpractice court judgments, arbitration awards and settlements of medical malpractice claims made to a complaining party over the last five years, as well as malpractice claims that are under appeal.

Salvi praised another provision of the act as well.

?The other significant feature is that access to the profiles is not just limited to those who have the Internet,? the Chicago attorney explained. ?Patients can request the same information in writing from the Department of Professional and Financial Regulation. That?s particularly important because lower-income families will be able to conduct the same kind of research as everyone else, which can be extremely helpful if they suspect they are victims of medical negligence but are hesitant to contact a lawyer.?

Medical malpractice and hospital negligence can often have tragic consequence for families, Salvi said.

?Some errors will prevent patients from being able to work in the same profession they did before the medical mistake, or will prevent babies from leading normal lives because of a surgical mistake in the delivery room,? Salvi said.

?But it?s important to remember that there are a lot of highly qualified, ethical physicians in Illinois,? he continued. ?The Patients? Right to Know Act is not intended to punish them for past mistakes. It just says that the public has the right to know what those mistakes were so that they can make informed decisions about their future care.?

Question by krystinak4903: How long do Dr’s have to release medical records to an attorney after they receive the release?
I am suing a Dr for malpractice & Negligence, and I signed the papers to release medical information for my son, however I know (I’m was a medical assistant- I just don’t remember the answer to my own question lol) there is a certain amount of time that Dr’s are “allowed” to present the records. How long is that?? I can’t remember, and its driving me nuts. Any help would be appreciated! Thanks!!
No, there is certain set time set..legally. That they have to release the records…its like 60 days, or 6 months or something, but there is SOMETHING about a certain set time…i know it is a ridiculous amount of time given Dr’s never want to give up information that could harm them. And i know since i have worked in Dr’s offices it can be done in a much smaller amount of time, but I’m trying to figure out what the max time we wait is. Thanks
I could swear in MI there is a set time…Obviously I could be mistaken, the attorney just told me that the Dr’s will take as long as they can to hand them over, and I remember when I worked in a Dr’s office they would talk about how time was “almost up” to send the records.

Best answer:

Answer by Max Hoopla
A reasonable period of time. Obviously a squishy answer.

Question by news-n-more-news: Retaining attorney for possible MEDICAL MALPRACTICE suit, is it advisable if?
suspecting some of the negligence/malpractice is due to GOVERNMENT imposed regulations such as “compliance agreements”?

In other words if I suspect_and am starting to try and prove so_that some if not all negligence against patient has been caused because of stringency in an “agreement” from hospital with government after a settlement suit won by government, what would my chances of success be in taking the case to court against hospital?

Also, if notwithstanding this “agreement” in which medical professionals might be “afraid” to issue more tests, treatments, etc. If I can find that based on the settlement amount paid by hospital, the patient, or patients are suffering negligence, should I be suing the government instead?

PLEASE, if this sounds confusing or more information is needed I’m glad to provide it. I am NOT doing this for ANY monetary gain. I just want justice done.

Best answer:

Answer by kuppkake
if you believe the hospital’s actions were, in fact, caused by government regulations, then by all means, sue the govt. (the hospital has to go by govt. regulations, or lose their funding)
