Article by Alexander Belanger Woo

We have been transformed into such a litigous society and that is assuredly augmenting the cost of living.

Malpractice is defined as erreneous or negligent practice by a lawyer, physician, or other professional that creates injury to a client or patient. Malpractice, as a standard of legal accountability applies only to professionals. The areas in which a appraisal of malpractice can be made, are specialized fields that normally require training and specialized skills.

The dollar value amount of malpractice lawsuits is overwhelming.

Malpractice is legally defined as a type of negligence, where the nonfeasance or wrong-doing or the misfeasance of professional, in the duty of act, and fails to follow the rules and accepted professional standards. The contravention of duty can result in injury or even fatality to the affected person.

Malpractice and negligence may arise through the exclusion of a necessary act, or commission of an unwise or negligent act. It has become quite troublesome in our society over the past two decades and until recently not much has been done to help deter malpractice or to help inform the public of instances of malpractice. The costs involved in jury awards can have a ripple effect. We may think very little of the frivilous lawsuits that may be filed, but in almost every industry, safeguarding against malpractices has become essential. In fact, in some states, having malpractice insurance is now mandatory. In the medical community Malpractice is an ugly word for both patients and doctors. For patients, it can mean that a doctor botched a routine surgery, resulting in years of chronic pain. Nurses appear to be vulnerable and hospitals are instituting additional practices to safeguard against malpractice cases. There are even known cases of clergy being sued for malpractice.

Some doctors attest that premiums for malpractice insurance can run up to 0,000 a year for specialized areas such as neurology or obstetrics. It is estimated that about 5% of medical costs are directly attributable to malpractice premiums and another 5% to defensive medicine. These costs are then passed on to the consumer. In recent years, there have been complaints voiced by many doctors and politicians, that frivolous malpractice lawsuits and extraordinary jury awards are a problem in need of reform. The litany of seemingly excessive extraordinary monetary awards is extensive, but the number proliferates and it appears that legal malpractice claims are on the rise.

There is still considerable debate as to the cause and effects of the problems. Are the malpractice attorneys to be blamed? The undeniable truth is that malpractice lawyers operate a business. To remain in business, you cannot file frivolous malpractice cases. The economic reality of being a plaintiffs’ lawyer such as malpractice insurance attorney, is that you cannot afford to file a medical negligence lawsuit, unless you receive compensatory recovery. In spite of all of the chatter, It is more than common knowledge with those familiar with the judicial sytem that juries are going to err on the side of doctors. The costs involved with malpractice lawsuits are not cheap, and lawyers claim that the compensation should be on parallel with the costs. To stay in business as a malpractice lawyer, the cases must have merit, and should not be frivilous.

Others may disagree, that some of the outlandish awards, are in no way in line with associated costs.

There are services available to help you find a medical malpractice lawyer from a respected law firms in your area. If you need any information on medical malpractice insurance, medical malpractice law , medical malpractice cases, malpractice claims, information about your legal rights,or if or if you feel you have a case of malpratice or professional negligence, you should consult with an experienced malpractice attorney. The situation has either evolved or deteriorated, depending on your point of view to where lawyers can be sued for legal malpractice.

Malpractice lawsuits are big business, and never to be taken lightly.Malpractice lawsuits occur in almost every industry and the spiralling associated costs are undoubtedly having a ripple effect. For more information on appreciating the effects of malpractice on our daily lives, visit http://check-for-it.com/malpractice-attorney

Chicago, IL (PRWEB) August 18, 2011

Even though most patients want doctors to offer them treatment options, they prefer that doctors make the final medical decisions, according to a recently released University of Chicago Medical Center study.

The study suggests that when the best option for a patient is uncertain, doctors should make the difficult call, says Chicago medical malpractice attorney Patrick A. Salvi.

?These findings show that patients want to put trust in their doctors ? as they should ? and that doctors can?t avoid the ethical responsibility to use their skill and experience to decide the best course of treatment for their patients,? says Salvi, the managing equity partner of the leading Illinois medical malpractice law firm of Salvi, Schostok & Pritchard, P.C.

The study, released in June, collected data from 8,308 general internal medicine patients at the University of Chicago Medical Center. Ninety-seven percent of the patients said they wanted doctors to offer them choices and consider their views. But 67 percent said they also wanted their doctors to be the ones making the final decision.

Salvi says the study shows that the majority of patients may be at odds with a growing trend in the medical profession of leaving decisions to patients except when the medical situation involves a routine matter or emergency.

?By pushing a crucial decision onto a patient who lacks a medical background and knowledge, a doctor is not evading liability,? Salvi says. ?Instead, it may be simply sidestepping the duty to provide the best care possible.

?Patient-centered care means informing the patient and making sure the patient has as much information as needed to provide the doctor with informed consent, he says. “It does not mean passing off decision-making authority to the patient.?

Salvi?s Illinois law firm has represented numerous injured patients and their families in personal injury and wrongful death lawsuits throughout Cook County, Lake County and the state of Illinois, securing numerous multi-million dollar verdicts and settlements.

Based on his own experience of working with medical negligence victims, Salvi says patients want to trust the judgment of their doctors and other healthcare providers.

?A patient may be under tremendous stress, such as during childbirth or when facing a surgical procedure,? Salvi says. ?Doctors need to step up at those times and make the tough decisions.”

According to a recent story in the New York Times, 2% of the doctors in the state of New York have been placed on the New York state medical board’s watch list.

Now, thanks to the internet, the public has access to information regarding cases involving medical negligence and misconduct which attorneys point out can be found at nydoctorprofile.com. Many doctors on this list are being monitored for sexual misconduct, which can also lead to a temporary suspension of their medical license.
